These terms apply to your use of Welly and related services made available by Channing Schwaebe as an independent developer.
1. Acceptance of Terms
By downloading, accessing, or using Welly, you agree to these Terms & Conditions. Welly is independently operated by Channing Schwaebe. If you do not agree to these terms, do not use the app.
2. Use of the App
Welly is provided for your personal, non-commercial use. You agree not to misuse the app, interfere with its operation, reverse engineer it except where prohibited by law, or attempt to access systems or data that are not intended for you.
3. License
Subject to these terms and any App Store rules that apply, you are granted a limited, non-exclusive, non-transferable, revocable license to use Welly on Apple-branded devices that you own or control. This license does not transfer any ownership rights in the app, its design, content, or branding.
4. Purchases and Subscriptions
If Welly offers paid features, subscriptions and billing are handled by Apple through the App Store. Unless otherwise stated in the App Store listing, subscriptions renew automatically until canceled. You can manage or cancel subscriptions through your Apple ID account settings, and refunds are handled according to Apple's policies.
5. Health and Wellness Disclaimer
Welly provides wellness insights and informational content only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. It is not intended for emergency use or for diagnosing, monitoring, preventing, or treating disease. Always consult a qualified healthcare professional for medical concerns.
6. Data and Privacy
Your use of Welly is also governed by our Privacy Policy. Welly may read data you authorize through Apple Health and HealthKit to generate insights inside the app.
7. Limitation of Liability
To the fullest extent permitted by law, Channing Schwaebe is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Welly. The app is provided on an as-is and as-available basis, without warranties of any kind except where such warranties cannot be excluded by law.
8. Account and Access
Some parts of Welly may require account access, including Sign in with Apple. You are responsible for maintaining access to your device and Apple account. You are also responsible for activity that occurs through your device or account to the extent permitted by applicable law.
9. Suspension and Termination
Access to Welly may be limited, suspended, or terminated if you misuse the app, violate these terms, or use the service in a way that could harm the app, other users, or Apple platform compliance requirements.
10. Changes to These Terms
These Terms & Conditions may be updated from time to time. Continued use of Welly after changes take effect means you accept the revised terms.
